1. Acceptance of these Terms
By accessing or using the Planno platform (the “Platform”), you agree to comply with and be bound by these Terms of Use. If you do not agree with any part of these terms, you may not access or use our services.
These Terms constitute a legal agreement between you and Planno. We recommend that you read the whole document carefully before using the Platform.
2. Definitions
For the purposes of these Terms of Use:
- “Platform” refers to the Planno system, including the website, the application, and all related services.
- “User” refers to any person who accesses or uses the Platform.
- “Account” refers to the User’s individual registration on the Platform.
- “User Content” refers to all files, data, information, text, images, photographs, and other materials the User uploads to the Platform.
- “Services” refers to the functionality offered by the Platform, including file management, schedules, site visits, and team collaboration.
3. Registration and Account
3.1 Requirements
To use the Platform you must be at least 18 (eighteen) years old and have full legal capacity to enter into contracts. By creating an account, you represent that you meet these requirements.
3.2 Registration Information
You agree to provide true, accurate, and complete information during registration and to keep that information up to date. Planno reserves the right to suspend or terminate accounts containing false or misleading information.
3.3 Account Security
You are responsible for maintaining the confidentiality of your access credentials (email and password) and for all activity carried out under your account. If you suspect unauthorized use, notify us immediately.
4. Description of the Service
4.1 Functionality
Planno is a project management platform built specifically for architecture practices and construction professionals. The Platform offers:
- File management with support for a range of formats
- A visual schedule with interactive Gantt charts
- Site visit documentation with photos and notes
- Team collaboration with real-time synchronization
- Offline functionality with automatic synchronization
4.2 Plans and Subscriptions
The Platform offers free plans with limited functionality and paid plans with additional features. The specific conditions of each plan are available on our pricing page.
5. Acceptable Use
In using the Platform, you agree NOT to:
- Violate any applicable law or regulation
- Upload unlawful, defamatory, or obscene content, or content that infringes the rights of third parties
- Use the Platform for fraudulent or deceptive purposes
- Attempt to access restricted areas of the Platform without authorization
- Reverse engineer, decompile, or disassemble any part of the Platform
- Transmit viruses, malware, or any malicious code
- Interfere with the normal operation of the Platform or overload our systems
- Collect other users’ data without their consent
- Use the Platform to send spam or unsolicited communications
6. Intellectual Property
6.1 User Content
You retain all ownership rights in the User Content you upload to the Platform. Planno claims no ownership over your files, projects, photographs, or any other material you upload.
6.2 Operating License
By uploading User Content, you grant Planno a limited, non-exclusive, revocable license to store, process, and display that content solely for the purpose of providing the Services to you and to your authorized team members.
6.3 Ownership of the Platform
The Platform, including its design, code, functionality, brand, and logo, is the exclusive property of Planno and is protected by intellectual property law. No rights are transferred to the User beyond the right of use set out in these Terms.
7. Privacy and Data
7.1 Privacy Policy
The processing of your personal data is governed by our Privacy Policy, which forms an integral part of these Terms of Use. We recommend reading that document carefully.
7.2 Anonymized Data
Planno may use aggregated, anonymized data for analysis, improvement of the Services, and the generation of statistics. Such data does not permit the identification of individual Users.
7.3 LGPD
Planno is committed to complying with the Brazilian General Data Protection Law (Lei nº 13.709/2018, the “LGPD”) and other legislation applicable to the protection of personal data in Brazil.
8. Payments and Subscriptions
8.1 Paid Plans
Paid plans are charged according to the billing cycle you choose (monthly or annual). Specific amounts and conditions are available on our pricing page.
8.2 Automatic Renewal
Subscriptions renew automatically at the end of each period unless cancelled by the User before the renewal date. You will be notified before any charge.
8.3 Refunds
Refund requests are reviewed case by case. Please contact our support team for more information.
9. Cancellation and Termination
9.1 Cancellation by the User
You may cancel your account at any time through the Platform’s settings or by contacting our support team.
9.2 Data Retention
After cancellation, your data is retained for 30 (thirty) days so that the account can be reactivated if needed. After that period, all data is permanently deleted from our systems.
9.3 Termination by Planno
Planno reserves the right to suspend or terminate your account in the event of a breach of these Terms of Use, without prejudice to any other remedies available.
10. Service Availability
10.1 Best Efforts
Planno uses its best efforts to keep the Platform available and functioning correctly. However, we do not guarantee uninterrupted or error-free availability.
10.2 Maintenance
The Platform may be temporarily unavailable for scheduled or emergency maintenance. Wherever possible, we will notify Users in advance.
10.3 Modifications
We reserve the right to modify, suspend, or discontinue features of the Platform at any time, with reasonable prior notice where applicable.
11. Limitation of Liability
To the fullest extent permitted by law, Planno will not be liable for:
- Indirect, incidental, special, or consequential damages
- Loss of data, profits, revenue, or business opportunities
- Interruptions or service failures caused by factors outside our control
- Content uploaded by Users or third parties
- Unauthorized access resulting from the User’s failure to protect their credentials
In any event, Planno’s total liability is limited to the amount paid by the User in the 12 (twelve) months preceding the event giving rise to the claim.
12. Changes to these Terms
Planno may update these Terms of Use from time to time. When we make significant changes, we will notify you by email or through a notice on the Platform.
Continued use of the Platform after the changes are published constitutes your acceptance of the new terms. If you do not agree with the changes, you must discontinue use of the Platform.
13. General Provisions
13.1 Governing Law
These Terms are governed by the laws of the Federative Republic of Brazil.
13.2 Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Planno regarding use of the Platform.
13.3 Assignment
You may not assign or transfer your rights under these Terms without Planno’s prior written consent. Planno may assign its rights and obligations to third parties upon notice.
