1. Acceptance of Terms

By accessing or using the Planno platform ("Platform"), you agree to comply with and be bound by these Terms of Use. If you do not agree with any part of these terms, you may not access or use our services.

These Terms constitute a legal agreement between you and Planno. We recommend that you read this entire document carefully before using the Platform.

2. Definitions

For the purposes of these Terms of Use:

"Platform" refers to the Planno system, including the website, application, and all related services.
"User" refers to any person who accesses or uses the Platform.
"Account" refers to the User's individual registration on the Platform.
"User Content" refers to all files, data, information, text, images, photos, and other materials uploaded by the User to the Platform.
"Services" refers to the functionalities offered by the Platform, including file management, schedules, site visits, and team collaboration.

3. Registration and Account

3.1 Requirements

To use the Platform, you must be at least 18 (eighteen) years old and have full legal capacity to enter into contracts. By creating an account, you declare that you meet these requirements.

3.2 Registration Information

You agree to provide true, accurate, and complete information during the registration process and to keep this information updated. Planno reserves the right to suspend or terminate accounts that contain false or misleading information.

3.3 Account Security

You are responsible for maintaining the confidentiality of your login credentials (email and password) and for all activities conducted through your account. If you suspect unauthorized use, notify us immediately.

4. Service Description

4.1 Features

Planno is a project management platform developed specifically for architecture firms and construction professionals. The Platform offers:

File management with support for various formats
Visual scheduling with interactive Gantt charts
Site visit documentation with photos and notes
Team collaboration with real-time synchronization
Offline functionality with automatic sync

4.2 Plans and Subscriptions

The Platform offers free plans with limited features and paid plans with additional resources. Specific conditions for each plan are available on our pricing page.

5. Acceptable Use

By using the Platform, you agree NOT to:

Violate any applicable law or regulation
Upload illegal, defamatory, obscene content or content that infringes third-party rights
Use the Platform for fraudulent or deceptive purposes
Attempt to access restricted areas of the Platform without authorization
Reverse engineer, decompile, or disassemble any part of the Platform
Transmit viruses, malware, or any malicious code
Interfere with the normal operation of the Platform or overload our systems
Collect data from other users without consent
Use the Platform to send spam or unsolicited communications

6. Intellectual Property

6.1 User Content

You retain all ownership rights to User Content uploaded to the Platform. Planno does not claim ownership of your files, projects, photos, or any other material you upload.

6.2 License for Operation

By uploading User Content, you grant Planno a limited, non-exclusive, and revocable license to store, process, and display this content solely for the purpose of providing the Services to you and your authorized team members.

6.3 Platform Ownership

The Platform, including its design, code, features, brand, and logo, are the exclusive property of Planno and are protected by intellectual property laws. No rights are transferred to the User beyond the right of use as provided in these Terms.

7. Privacy and Data

7.1 Privacy Policy

The processing of your personal data is governed by our Privacy Policy, which is an integral part of these Terms of Use. We recommend careful reading of that document.

7.2 Anonymized Data

Planno may use aggregated and anonymized data for analysis purposes, service improvement, and statistics generation. This data does not allow individual identification of Users.

7.3 LGPD

Planno is committed to complying with Brazil's General Data Protection Law (Lei Geral de Proteção de Dados - Law No. 13,709/2018) and other applicable personal data protection legislation.

8. Payments and Subscriptions

8.1 Paid Plans

Paid plans are charged according to the chosen billing cycle (monthly or annual). Specific values and conditions are available on our pricing page.

8.2 Automatic Renewal

Subscriptions are automatically renewed at the end of each period, unless cancelled by the User before the renewal date. You will be notified before any charge.

8.3 Refunds

Refund requests will be analyzed on a case-by-case basis. Contact our support for more information.

9. Cancellation and Termination

9.1 Cancellation by User

You can cancel your account at any time through the Platform settings or by contacting our support.

9.2 Data Retention

After cancellation, your data will be retained for 30 (thirty) days to allow for possible account reactivation. After this period, all data will be permanently deleted from our systems.

9.3 Termination by Planno

Planno reserves the right to suspend or terminate your account in case of violation of these Terms of Use, without prejudice to other applicable measures.

10. Service Availability

10.1 Best Effort

Planno employs its best efforts to keep the Platform available and functioning properly. However, we do not guarantee uninterrupted or error-free availability.

10.2 Maintenance

The Platform may be temporarily unavailable for scheduled or emergency maintenance. Whenever possible, we will notify Users in advance.

10.3 Modifications

We reserve the right to modify, suspend, or discontinue Platform features at any time, with reasonable prior notice when applicable.

11. Limitation of Liability

To the maximum extent permitted by law, Planno shall not be liable for:

Indirect, incidental, special, or consequential damages
Loss of data, profits, revenue, or business opportunities
Service interruptions or failures caused by factors beyond our control
Content uploaded by Users or third parties
Unauthorized access resulting from User's failure to protect their credentials

In any case, Planno's total liability shall be limited to the amount paid by the User in the 12 (twelve) months preceding the event giving rise to the claim.

12. Changes to Terms

Planno may update these Terms of Use periodically. When we make significant changes, we will notify you by email or through a notice on the Platform.

Continued use of the Platform after the publication of changes constitutes your acceptance of the new terms. If you do not agree with the changes, you should discontinue use of the Platform.

13. General Provisions

13.1 Applicable Law

These Terms are governed by the laws of the Federative Republic of Brazil.

13.2 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Planno regarding the use of the Platform.

13.3 Assignment

You may not assign or transfer your rights under these Terms without Planno's prior written consent. Planno may assign its rights and obligations to third parties upon notice.
